Nationwide Building Society V Dunlop Haywards (Dhl) Ltd & Cobbetts (A Firm) [2009] EWHC 254 (Comm)- the Commercial Court
has considered the basis on which a fraudulent defendant is required to contribute towards the liability of a non-fraudulent co-defendant to the claimant. The amount of the damage to be apportioned between them was reduced to take account of the contributory negligence of the claimant but not to take account of a contractual limitation clause.
