Abbey National Plc V Office of Fair Trading [2009] EWCA Civ 116 – the Court of Appeal has upheld the High Court’s decision that various common bank charges were ancillary in nature and not part of the core bargain between bank and customer, such that the Office of Fair Trading was entitled to assess the fairness of such charges.
