The Commercial Court has given permission for a claim form to be served outside the jurisdiction where, although Russia was the natural forum, due to a significant risk of improper government interference, substantial justice might not be done to the Claimant if he commenced his claim in Russia. Such risks meant were sufficient to make England the suitable forum for the determination of the claim.
